Estate planning is a vital matter for all individuals, whether their estates are large or small. Planning provides peace of mind to the family that all aspects of one's estate will be handled expediously and as desired. The process is personal and individualized and includes the use of wills and trusts, powers of attorney, health care proxies, gift planning, special needs planning, estate tax planning, guardianships, and business succession planning.
As a part of estate planning, wills are necessary to effect the transfer of one's assets at death. Trusts are a tool that, as appropriate, can be used for efficient administration of assets, charitable giving, estate tax planning, and to achieve other directives.
Mr. Murphy represents fiduciaries who serve as Executors, Administrators and Trustees in regard to the effective and efficient administration of estates and trusts. From the initial stages of the probate or administration process for a decedent's estate, to the proceedings to handle and ultimately distribute the estate, all aspects are covered including preparation and filing of court documents, asset inventory, asset valuation, payment of debts, trust and estate accounting, and closing of the estate or trust. Dispute resolution or litigation is handled as necessary.
Mr. Murphy handles a comprehensive range of real estate matters including residential and commercial purchases and sales and lending transactions, title examinations, and title insurance. Mr. Murphy is also an approved examining counsel for Chicago Title Insurance Company and Stewart Title Insurance Company. From the formation of a corporation, a partnership, or a limited liability company, to the handle of legal matters for such entities and their merging, dissolution, or sale of the entity, if necessary. Mr. Murphy has extensive experience in handling all of these matters. His clients range from small, closely-held entities to larger corporate entities with on-going general business law needs.
Mr. Murphy understands the unique legal requirements and needs of not-for-profit entities. He handles basic matters such as incorporation, drafting certificates, by-laws and other corporate documents, on-going legal issues, and compliance with government rules and regulations. He also handles applications for tax-exempt status under Section 501(c) of the Internal Revenue Code, and under state and local regulations.
